These Terms govern your use of RM Web Development’s after-hours lead capture product (the “Service”). By using the Service, you agree to these Terms. This summary is not legal advice; consult your counsel for obligations specific to your business.
The Service provides after-hours chat, qualification, and lead handoff to destinations you specify (email, Google Sheets, CRM/webhook, or other approved channels). We offer three deployment paths: cloud API (default today), RM-managed secure cloud (coming soon), and Local Appliance (on-prem hardware installed at your location).
Fees are one-time setup amounts unless otherwise stated. Payment terms, scope, and deliverables are defined in your order or statement of work. Additional integrations or changes outside the agreed scope may incur extra fees.
Use of the Service is subject to our Privacy Policy. You are responsible for complying with applicable data protection laws for your use of the Service and for providing required notices to your visitors.
We retain all rights to the Service, underlying software, models, and configurations. You retain rights to your content and business information provided to us.
The Service is provided “as is” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted/ error-free operation.
To the maximum extent permitted by law, RM will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claims arising from the Service is limited to the amounts you paid for the Service in the 12 months preceding the claim.
You agree to defend and indemnify RM against third-party claims arising from your misuse of the Service, violation of laws, or content you supply, except to the extent caused by RM’s breach of these Terms.
We may suspend or terminate access for misuse, security risks, non-payment, or legal compliance reasons. You may terminate by stopping use of the Service; accrued fees remain payable.
These Terms will be governed by the laws applicable in the jurisdiction where RM Web Development is organized, without regard to conflict of laws rules. Venue for disputes will be in that jurisdiction’s courts.
We may update these Terms. The “Effective date” above will change when updates are posted. Continued use of the Service after changes means you accept the updated Terms.
